This privacy notice covers the collection, use, disclosure, security, access and correction of information about an identifiable individual ("Personal Information") via the EM6 website at www.em6.co.nz (“Website”), whether that information is manually or digitally processed.

1. What Personal Information does EMS hold?

EMS collects and keeps Personal Information such as names, email addresses and employer name for allocating and authenticating users of the EM6 services (“the Service”), as well as associated purposes set out below in paragraph 2.

When you visit the Website, EMS also collects information to help it understand how the Website is working and how EMS could improve it and/or the Service. To collect this information about the Website and help EMS analyse it, it uses services such as Google Analytics. These services collect a range of mostly anonymised information, such as the number of visitors on the Website per day, which pages you visit, some content you enter, see and interact with when you visit and use the Website, your computer’s internet protocol address and operating system, the date and time of your visit, location, browser type and language, referring website addresses, and the types of devices you use to visit the Website.

These services also infer or collect demographic profiles about Website users (e.g. age and gender), through a range of techniques including cookies from websites you visit and, in the case of Google Analytics, from other Google services. If you don’t provide EMS with the information requested, EMS will not be able to provide you with the Service.

2. Collecting, Using and Disclosing Personal Information

EMS only uses Personal Information to:

  • verify that users are associated with a subscription payer entity;
  • format and/or transmit the content of the messages that clients, subscribers, recipients of information and third parties receive via the Service;
  • perform the Service requested;
  • improve the Website and EM6 services including analysing trends, optimising the configuration of the Service and messages, tracking the performance of referring websites, administering the Website and monitoring your interactions with it;
  • correspond with, conduct user verification, account management and billing;
  • respond to enquiries and feedback;
  • perform troubleshooting and offer support;
  • manage and deal with suppliers, subcontractors and agents efficiently;
  • consult with legal or professional advisers as required;
  • disclose to a potential purchaser of EMS’ business or assets (or part of it or them) subject to appropriate confidentiality requirements; or
  • respond as required by regulators or the law.

EMS respects the privacy of users visiting the Website and does not share any personally identifiable information with any third parties except our subcontractors and agents who are bound by contracts which contain confidentiality, privacy and security requirements.

3. Data Security

EMS utilises reasonable and appropriate protections to ensure that Personal Information in its care is not misused, lost or accessed without proper authorisation. Access to Personal Information collected is restricted to those employees or contractors who require such access to perform a legitimate business purpose relating to the Service, such as maintenance, internal security or other related issues.

All EMS employees and contractors, are required to sign a strict and detailed confidentiality agreement, including in relation to the Personal Information that they will have access to.

4. Correction of Personal Information

EMS takes reasonable steps to ensure that all Personal Information that it holds is accurate, complete and up to date. You should notify either your employer (if your employer is the subscriber to the Service) or EMS if there are any changes to your Personal Information, or if any Personal Information that EMS holds about you is incorrect or out of date. 5. Access to Personal Information

6. Opt-Out of Mailing Lists

If you wish to remove yourself from communications sent via the EM6 mailing lists, you should follow the instructions to unsubscribe found within the sent message.

7. Review of Compliance

EMS may review and amend this Privacy Notice from time to time. If it does so it will let users know via a message on the Website for 30 days and will update the date of the Privacy Notice shown below.
